Mr W. Brown, Butcher of Newhall, exhibited at Swadlincote on Saturday his Shorthorn Heifer, winner of a Gold Medal at Shrewsbury Christmas Show, first prize Derby Show, and other First Prizes

At the Burton County Court last evening, W. Brown, butcher of Newhall sued Frank Rowland, farmer of Anbury Wood End, for 7 pounds damages for breach of warranty in respect of the sale of a cow in November last

Mr PW Musson appeared for the plaintiff & Mr Bendle Moore Appeared for the defence

William Brown stated that in November he went to the defendants place and the defendant offered to sell him two cows.
The defendant showed him a little milking cow, which the plaintiff thought appeared good.
The defendant asked 10 pounds and the plaintiff offered 9 pounds.
No deal was made that day

Later, the defendant dropped to 9 pounds, and the plaintiff replied that if the defendant brought the beast to the Burton Market they could go home with his other fat cattle

The defendant took the beasts to his home and on visiting the field he saw the cow coughing, as a result of which a portion of its bowel was protruding.
It was subsequently found dead.
The dead animal he valued at 2 pounds

The week after, a witness saw Rowland at the Burton Market, when the latter agreed to pay half the loss.
The defendant did not pay and [on] the following Monday, the Defendant again promised to settle but has never done so

Bemjamin Guy (in the employ of the plaintiff) corroborated the evidence of the plaintiff

Judgment was given to the defendant with costs.
