When The User provides such information to us, consent is implicitly inferred to The Owner's collection, retention & use of it

8.3 Business related information

If The User is an individual associated with a business or another organization that is The Owner's customer, personal information may include the following information that The Owner links back to their business or organization (such as name, address, telephone numbers, payment arrangements, financial information, etc), their relationship with that business or organization (such as owner, partner, director, shareholder, employee, or agent) and their contact details within that business (such as work address, work telephone & mobile numbers, work fax number & work eMail address)

8.4 Inquiry and booking information

Information concerning inquiries & bookings made with or through The Owner for service, including where The User made the inquiry or booking or are the recipient of the services to which the inquiry or booking relates. This information may include records of inquiries & searches for products made by or on their behalf, details of their personal interests, needs & other information relevant to their inquiry; details of results, quotes, proposals, estimates & other information given in response to inquiries; details of accommodation, car hire & other services booked or inquired about; details of provider of services; dates & times; price; payment details (including card details); passport information & visa information; foreign exchange requirements & arrangements; and sensitive information such as health, medical, dietary, mobility, disability, religious or other special conditions or requirements

8.5 Performance information

Information generated concerning performance of any booking or other contract made with or through us, including information relating to anything arising during any holiday or other services & information relating to payments to be made

8.6 Survey Information

Information collected or generated out of any surveys that The Owner conducts

8.7 Feedback and User Generated Content (UGC)

Information or content provided by The User in relation to their feedback or experience on a past or current or visit with us

8.8 Competition information

Information collected or generated out of any competitions or promotions that The Owner runs

8.9 Account, registration and loyalty information

Information concerning any account, registration, or membership with us, or participation in any loyalty program

8.10 Correspondence

Correspondence, communications & messages, including those between The User and The Owner, and between us and third parties, including relating to any inquiry, or performance of any contract

8.11 Social media

Any information (including social media user details, feedback, comments & photos) that The User posts on The Owner's social media channel or any forum which relates to us may be used

8.12 Website usage information

We may collect information about The User's visits to, browsing of & use of The Owner's websites, unless their web browser blocks this; the range of information that we collect will depend on how The User interacts with our websites

The information may include the following:
* The User's IP address (unique id from the TCP/IP protocol allocated to their
  computer for their connection to the internet);
* their computer device details (PC, tablet, smartphone, watch etc);
* the make &  version of web browser (e.g. Internet Explorer, Firefox, Safari, Opera,
  Chrome) The User is using;
* their operating system (e.g. Windows, Windows Phone, OS X, iOS, Android, Linux etc);
* their time-zone;
* their browser plug-ins;
* any web-page The User came from, identified as the referrer web page address by their web
  browser;
* cookies;
* page response times;
* download error;
* pages & parts of pages The User visits;
* usage The User made of our websites, including inquiries & searches undertaken,
  and registrations for accounts, forums etc;
* services & products that The User viewed;
* length of visit to website & pages; and
* page interaction information (such as scrolling, keys pressed, mouse clicks,
  touches & mouse-overs)

This will normally be collected & used anonymously and aggregated for analysis, with their name & any characteristics identifying The User remaining anonymous, but our Policy will apply and it will be treated as personal information, if this information is linked to The User personally

The information may also include information that is input to forms and fields; registrations for accounts, forum, feedback mechanism, social functionality, newsletters or other features of our websites; usernames, passwords, log-in/out history & settings; actions taken within any account or other registration, including view & update and changes to settings; and posts to any forum, feedback, review or other social functionality on our websites

8.13 Video and audio

There may be circumstances, whether for security or other reasons, in which The Owner makes video or audio tape recordings that may include The User's appearance, activities and/or communications

8.14 How The Owner Collects or Generates The User's Personal Information

The Owner may collect or generate personal information concerning The User in various ways

8.15 Visiting The Owner's Websites or Telephoning Us

By visiting our websites The User may provide personal information to us, which includes:
* information which is automatically provided by their browser to our servers;
* information recorded on our web servers about their interaction with our websites and
  pages viewed;
* information we capture or place on their computer or generate using cookies or other
  technologies on our websites; and
* information The User inputs into forms & fields on our websites

By telephoning us The User may provide personal information; we may record telephone calls with them

Cookies - Cookies collect information that includes the server their computer is logged onto, their browser type and how The User gained entry to our websites

When The User visits any of our websites anonymously, details are still recorded about their visit, such as matters described in the prior paragraph, time & date, pages accessed and time spent. This information is used in an anonymous form for statistical purposes and as such, is not normally used to identify them individually

We do not seek to retrieve other information from cookies, their hard drive, pass on computer viruses or capture their eMail address, or other personally identifiable information

Accepting cookies is required if The User wants to view our websites, because The Owner considers them to be essential for our site administration & security. They may disable cookies or set their browser to alert themselves when cookies are being sent. If they disable cookies, we may be unable to optimize their visit to our site & they User may experience some errors. Refer to their browser instructions or help screens to learn about these functions. If they reject all cookies, they may not be able to use our websites

8.16 Information The User provides

The User's personal information will include information provided (or later amended), whether:
* from correspondence with The User;
* verbally to The Owner over the phone or in person;
* by filling in a field or form on a website;
* by posting on our social media channel;
* by posting on any forum referencing us;
* by filling in any printed form The Owner provides to The User;
* by eMail;
* from documents The User provides to us; and
* from updates to any information provided from time to time

This includes when The User registers or subscribes for any service, account, members, or loyalty program, or make an inquiry or other service whether in person, by phone, through The Owner's website or otherwise; send us their comment or suggestion; subscribe to any newsletter or other publication; or request sales & advertising information, including brochures

If The User does not provide us with their personal information, we may be unable to provide them information or book services for or on their behalf

8.17 Information obtained from third parties

The Owner may obtain personal information concerning The User from third parties, including from people making inquiries or bookings on their behalf, providers of any accommodation, other services which are inquired about or booked & their intermediaries; credit, fraud, identity & other searches we may undertake, including searches with public records & regulatory and private organizations; from social media and other information sources we may examine; from any business or organization The User is associated with; or from telephone numbers identified by the telephone system when The User telephones us

8.18 Information generated by The Owner

We & any suppliers or contractors or subcontractors working for us may generate or create personal information relating to The User, including in connection with responding to & dealing with any inquiry, booking or complaint; or in performing any booking or other contract with The User; or through the analysis of their personal information or information gained from their use of The Owner's websites or through study or analysis of information provided to or obtained by us

8.19 Video or Audio Recording for Security

The Owner, or others that we contract with, could use recording equipment, typically for security purposes, that electronically records activities & sounds coming within the range of the recording device

9. What does The Owner use The User's Personal Information for?

9.1 Operate The Owner's websites

To operate and provide the search, booking, accounts, review, forums & other services, facilities & functions of our websites; this includes customizing The User's online experience by providing more relevant online offers & updates, managing accounts or registrations they may have with our websites, and making changes to their settings & profile at their request

9.2 Provide information and respond to inquiries

To provide information to The User about our website, systems & services, including responding to inquiries & searches and provide The User with updated information

9.3 Bookings and other contracts

To enable The User to make bookings and to fulfill, provide, perform, administer, manage & enforce bookings, orders & other contracts which relate to The User (including if The User is a passenger in a booking made by someone else) and to process transactions authorized or made with The Owner which relate to The User

9.4 Payments

To collect and make payments due & administer our accounts

9.5 Communication with customers

To communicate with The User concerning inquiries, bookings, services provided, problems & complaints and responding to submissions, inquiries or requests from them or others that are related

9.6 Record keeping

To keep internal records and maintain reasonable archives for future use & reference, including as to inquiries, bookings, contracts, services & complaints

9.7 Manage and improve our business

To analyze, audit, provide, operate, administer, maintain & improve our business, website, systems & services; to carry out surveys & analyze results; run promotions & competitions; undertake product or customer research/development; assist The Owner and help us improve our sales, editorial, advertising & marketing processes; carry out other business development & improvement activities; and provide training to our staff, subcontractors & suppliers

For example, we may use their personal information to help us profile how customers generally are using our websites & booking services with (or through) us. We may use this information to ascertain interests so we can better tailor our business offerings

9.8 Direct marketing

To carry out direct marketing to The User. See next section below for further information

9.9 User Generated Content (UGC)

9.9.1 Use of Reviews

This Policy directs that by submitting content to our websites via electronic mail, postings on our websites or otherwise, including any reviews, questions, comments, suggestions, ideas, photos or the like contained in any submissions (collectively, "Submissions"), The User grants The Owner and our affiliates a nonexclusive, royalty-free, perpetual, transferable, irrevocable and fully sub-licensee right to
  (a) use, reproduce, modify, adapt, translate, distribute, publish, create derivative
      works from and publicly display & perform such Submissions throughout the world
      in any media, now known or hereafter devised; and
  (b) use the name that The User submits in connection with such Submission

9.9.2 Use of User Generated Content (UGC)

This Policy also directs that by submitting content to our social media channels or websites, The User grants The Owner a non-exclusive license to use the content The User adds to our websites. For example, The Owner may use this information in any of our brochures or for our campaigning purposes or marketing materials

9.10 Advertising

To report aggregate information concerning usage of our websites to our advertisers. The Owner normally creates anonymous statistical information about browsing actions and patterns & do not identify any individual

9.11 Security

Video & audio recordings may be examined & reviewed for purposes of reconstructing or understanding courses of events that preceded or led to a security or safety matter or other incident

9.12 Legal Obligations

We will cooperate with "them", e.g.
* government,
* police,
* military,
* a private entity,
* judicial authorities or
* certain other organizations
to meet our legal obligations & to provide information in response to a command or request from, or to cooperate with them, from acting at the request or in service of them, or in some cases from an international or aid organization

This could include, by way of example, any of them that requires or asks The Owner to voluntarily cooperate in providing information for their investigation of any matter or for purposes of a pending proceeding

This could also include a request to us from an international organization or aid organization, such as in the case of an emergency or for other reasons

We may also provide information to any such organizations in matters for which The Owner may request their assistance

When, if necessary, The User finds a need for legal advice or an action, they shall seek proper legal or professional advice beforehand

9.13 Anything The User specifically Consented To

Any purpose for which The Owner has obtained The User's consent

10. Use of The User's Personal Information For Direct Marketing

We do not use or disclose The User's personal information for direct marketing purposes unless The Owner obtained The User's consent to this, such as through an opt-in or opt-out click box on any form or website of ours

10.1 Direct marketing by us

If The User consented to this, The Owner may use their personal information to carry out direct marketing & send them marketing messages, materials, advertisements & promotions relating to services we provide or which can be booked with third parties through us, or which are offered by or which can be booked through any other company in the same group of companies as us (that is, within the Corporation group) or third parties selected by us

The User can withdraw their consent by contacting us as detailed in Section 6 of this Policy or as detailed in any direct marketing they receive

10.2 Direct marketing by third parties

If The User consented to this, The Owner may disclose their personal contact information (such as name, eMail, postal address, telephone, mobile or fax number) to any other company in the same group of companies as us (that is, within the Corporation group), or to third parties selected by us. They may use this to carry out direct marketing in their own right & to send The User marketing materials, advertisements & promotions relating to products and services they offer or which can be booked through them

The User can withdraw consent to our disclosure of their personal information for this purpose by contacting us as detailed in Section 6 of this policy

If The User withdraws consent, this will not affect disclosures we may have already made (that is, we will not remove their personal information from anyone we disclosed it to), but we will tell them who they are on request, and they should contact them directly concerning this

11. Disclosure of The User's Personal Information

We transfer The User's personal information to third parties in the following circumstances

11.1 Bookings and performance of contracts

We disclose The User's personal information to third parties (including intermediaries) to deal with any booking inquiry made by or for The User, to make any booking requested by or for The User, to perform & administer any booking for The User or other contract with or in respect of The User. This may include to apply for visas on The User's behalf, to collect payments to be made by The User, to investigate & respond to complaints & to enforce any booking or other contract with The User. Third parties may include suppliers, contractors or subcontractors and their agents (e.g. airlines, coach, ferry or train companies, hoteliers, hire companies, cruise companies, tour operators etc)

11.2 Suppliers of and other services

We may disclose The User's personal information to any third party (e.g. supplier, contractor subcontractor. etc) The Owner makes any inquiries with, concerning or engage or subcontract to perform any booking or other contract, including to provide any travel, tour or other products or services we agreed to provide to The User

We may disclose The User's personal information to any supplier with whom we make any inquiry concerning or book any or other products & services for The User as agent (whether as agent for The User, someone representing The User, or the supplier), such as a tour operator. Details of any third party tour operators or other third parties who will be responsible for or supply The User with the services booked or inquired about, may be obtained from us on request and may be stated in any tour or other brochure provided by us

11.3 Insurance

If an application is made through The Owner for other insurance to cover The User, we may pass their personal information to the insurer. Information provided by The User may be put on a register of claims & shared with other insurers seeking to reduce fraudulent claims

11.4 Business function outsourcing

When The Owner uses third parties to host, provide, operate or supply any part of our websites, databases, systems, business, or services, or carry out any of our business functions or actions (including sending mail, processing payments, providing marketing assistance, providing customer & advertising analysis and providing customer services), we may provide The User's personal information to them as required for use for or processing as part of those purposes

11.5 Public forums, etc

When any facility on our websites are designed to make some of The User's personal information public (e.g. posts The User makes to any public forum or reviews facility) then personal information The User provided in relation to that forum or other facility, which is provided in circumstance where it is intended to be published, will be disclosed to the public accordingly, subject to moderation by us

11.6 Legal requirements or matters of cooperation

The Owner may supply personal information to a government authority or regulator, police authority, military authority or private party acting for or on behalf of such authorities, where required to comply with a legal requirement, for the administration of justice, for purposes of customs, visas and immigration, when reasonably required to protect The User's interests or enforce any booking or other contract, where useful to enforce or protect our rights, or where we elect to voluntarily cooperate with a request from any such person or entity, for other reasons

We may disclose The User's personal information where otherwise required by or permitted by law; see Section 4. Copyright Notice & Intellectual Property. We may also provide information to such organizations in matters for which we request their assistance

11.7 Direct marketing by third parties

We may disclose The User's personal information to third parties to carry out direct marketing to The User, where The User has given consent, to third parties to carry out direct marketing. See the direct marketing section above

11.8 Customer representatives

If our customer is a business or organization and The Owner holds The User's personal information in The User's capacity as an associate of that business or organization (including as agent, representative, contact, employee, officer, owner, partner, or director), we may disclose to them that personal information

If our customer is making a booking or booking inquiry on The User's behalf, with The User's authority, we may disclose to our customer The User's personal information as reasonably required in connection with the booking or inquiry, or the subsequent performance of or payment for any booking made

11.9 Business acquirers

If The Owner's business is ever transferred to a third party, then The User's personal information will be transferred to the acquirer to enable them to continue our business. If we are in discussions for a transfer, The User's personal information may be transferred as part of those discussions

11.10 Intermediaries

In the process of providing personal information as stated in this Policy, information will be provided to and will pass through and could be retained by various service providers along electronic, digital & various other transmission routes

11.11 Unintended Transfer

No system or measures can assure full security. Our facilities and / or data could be accessed unlawfully or otherwise without our consent. The User's personal information could be transferred to the persons engaging in such unlawful or un-consented access & they could transfer personal information to others beyond our control. The User must accept these risks

12. How Third Parties will Handle The User's Personal Information

Where The Owner provides The User's personal information to a third party, except as stated in Section 12.11, one of the following three circumstances will normally apply

12.1 Processing on our behalf

In some cases, The User's personal information may be held & otherwise processed by them on our behalf, in which case we will remain responsible for what they do with The User's personal information & we will require of them that The User's personal information be held & processed by them in accordance with our instructions and this Policy

12.2 Processing on their own account

In other cases, The User's personal information may need to be provided to them to be held & processed by them in their own right and on their own account. In such case, they will have their own responsibility for that personal information, subject to their own privacy policy and we will not be responsible for what they do with it following disclosure

12.3 Handling According to Legal Requirements

When we provide The User's personal information to a government authority (including a regulator, police authority, military authority or private party acting for, or on behalf of, such authorities), we may not be able to control or impose requirements how they handle the information

13. Location of The User's Personal Information

13.1 Transfer of personal information overseas

We (and any affiliate, subcontractor or other person processing The User's personal information on The Owner's behalf) may transfer, store & otherwise process The User's personal information anywhere in the world to fulfill the purposes in this Policy, for example to
  a) our overseas offices;
  b) information processors (including operators of global distribution systems);
  c) airlines, hotels & other service products;
and information technology & business service providers

In many cases transfer is necessary to initiate or complete a booking or other transaction on The User's behalf in response to a request by The User or for the purpose of entering a contract with a third party on The User's behalf

Where The Owner discloses The User's personal information to third parties, that disclosure may also involve a transfer of The User's personal information anywhere in the world and those third parties may themselves transfer, store or otherwise process that information anywhere in the world
